Attendance Liability and Risk

Attendee assumes all risks and accepts sole responsibility for any injury (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that attendee may experience or incur in connection with attending the Worldwide ERC event(s), including but not limited to, pre-conference events, the Foundation for Workforce Mobility gala and related fundraising events. Attendee hereby releases, covenants not to sue, discharges, and holds harmless Worldwide ERC®, its employees, agents, and representatives, of and from any such claims, including all liabilities, claims, actions, damages, costs, or expenses of any kind arising out of or relating thereto. 

Specifically relating to the global COVID-19 pandemic, attendee acknowledges the highly contagious nature of COVID-19 and voluntarily assumes the risk of exposure or infection by attending the Worldwide ERC event(s), and that such exposure or infection may result in personal injury, illness, disability, and/or death to attendee. Attendee understands that the risk of becoming exposed to or infected by COVID-19 at the Worldwide ERC event(s),  may result from the actions, omissions, or negligence of others who may attend the event or their families, colleagues, or others with whom they may have contact. Accordingly, attendee understands and agrees that this release includes any claims based on the actions, omissions, or negligence of Worldwide ERC®, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in the Worldwide ERC event(s), . 

In addition to all other rules and regulations relating to the attendee’s attendance at the Worldwide ERC event(s), attendee agrees to comply with all COVID-related procedures that may be implemented by Worldwide ERC® and the event venues, including, but not limited to, mask-wearing and social distancing requirements and restrictions on certain activities that carry higher COVID-related risk, in order to protect as much as possible the health and safety of all Worldwide ERC event(s) attendees. Attendees who fail to comply with health and safety measures may be expelled from the conference without a refund at the discretion of the conference organizers.

Code of Conduct 

The Worldwide ERC event(s) brings together a community of professionals from around the world to network, learn and share ideas about global mobility. Worldwide ERC® is dedicated to providing a safe, inclusive, welcoming, professional, harassment-free event experience for everyone regardless of gender, gender identity and expression, sexual orientation, disability, physical appearance, body size, race, age, ethnicity, religion and any other status protected by laws in which the event is being held. We do not tolerate harassment in any form. All participants, including attendees, organizers, speakers, trainers, sponsors, exhibitors, vendors, volunteers, and event staff are expected to behave in accordance with professional standards, applicable laws, and to their respective employer's policies governing appropriate workplace behavior. Sexual language and imagery is not appropriate for any conference venue, including talks, workshops, parties, Twitter and other online media. Conference participants violating these rules may be expelled from the conference without a refund at the discretion of the conference organizers.

Privacy

You agree to abide by the Worldwide ERC Privacy Policy which can be found at https://www.worldwideerc.org/privacy.

Through the Conference website, your name and contact information are visible and/or accessible to other Conference attendees unless you opt out through the directions noted in the Privacy Policy.

Reporting Inappropriate or Abusive Content or Behavior

If you come across content or encounter behavior that you believe falls outside of the Terms and Conditions, please contact Worldwide ERC staff immediately.

Antitrust

Federal Antitrust laws prohibit agreements among companies not to compete on price, compensation, recruitment or other practices which may stifle competition. 

In compliance with antitrust requirements, Worldwide ERC® publishes surveys reporting composite data about benefits and costs related to global mobility.   During the Conference, you can ask general questions about such benefits and costs but you cannot ask specific questions such as how much is the total dollar value that an attendee will currently pay to a transferee moving from X to Y or how much is the maximum commission that an attendee will pay to a real estate broker.

The government antitrust enforcers believe that general information provided by a trade association usually promotes competition but direct one on one communications between companies involving specific details of salaries, benefits or pricing  is anti-competitive and could violate the Antitrust laws.

Event Cancellation by Worldwide

If for any reason beyond Worldwide ERC’s control Worldwide ERC determines that WORLDWIDE ERC EVENT(S) must be cancelled, shortened, delayed, dates changed, or otherwise altered or changed, Participant understands and agrees that WORLDWIDE ERC shall not refund the registration fees paid and that all losses and damages that Participants may suffer as a consequence thereof are their responsibility and not that of WORLDWIDE ERC or its directors, officers, employees, agents or subcontractors. Participants understand that it may lose all monies it has paid to WORLDWIDE ERC for participation in WORLDWIDE ERC EVENT(S), as well as other costs and expenses it has incurred, including travel, lodging, etc.

Internet Disclaimer

Worldwide ERC will provide you online access to WORLDWIDE ERC EVENT(S) via the Internet by use of your Internet browser. You are solely responsible for obtaining and maintaining at your own expense, all equipment needed to access WORLDWIDE ERC EVENT(S), including but not limited to Internet access and adequate bandwidth.  USE OF OR CONNECTION TO THE INTERNET PROVIDES THE OPPORTUNITY FOR UNAUTHORIZED THIRD PARTIES TO CIRCUMVENT SECURITY PRECAUTIONS AND ILLEGALLY GAIN ACCESS TO THE EVENT AND CUSTOMER DATA. ACCORDINGLY, WORLDWIDE ERC CANNOT AND DOES NOT GUARANTEE THE PRIVACY, SECURITY OR AUTHENTICITY OF ANY INFORMATION TRANSMITTED OVER OR STORED IN ANY SYSTEM CONNECTED TO THE INTERNET.

Liability Wavier and Release

In consideration of being allowed to register for, and participate in WORLDWIDE ERC EVENT(S), you hereby warrant and represent that you are age 18 or above and freely waive, release from liability, assume all risks, and covenant not to sue WORLDWIDE ERC or its members, employees, board members, agents, or volunteers for any expense, loss, damage, personal injury, including loss of life, illness, disability, property damage, or property theft or actions of any kind that you may hereafter suffer or sustain before, during, or after the event, unless said expense, loss, damage, personal injury, including loss of life, illness, disability, property damage or property theft or actions of any kind is caused by the sole, gross negligence of WORLDWIDE ERC. This Liability Waiver & Release is specifically binding upon your heirs and assigns and is knowingly given.

Photography Release

On occasion, you may be photographed, video-taped, or audio-taped in connection with WORLDWIDE ERC activities. As a participant of WORLDWIDE ERC EVENT(S), you agree that WORLDWIDE ERC is the sole owner of all rights in and to the resulting photographs, video footage and recordings, for all purposes related to WORLDWIDE ERC's business (both now and in the future). Your name and likeness may be used by WORLDWIDE ERC in advertising and promotional materials. Participants shall receive no compensation or royalties for appearance in any materials.
